Terms of Service

These Terms of Service ("Terms") are an agreement between you and {{LEGAL_ENTITY}} ("Sell Traces", "we", "us"). They cover selltraces.ai, dashboard.selltraces.ai, our API, and the selltraces command line tool (together, the "Service"). By using the Service you agree to these Terms.
If you upload traces, our Contributor Terms also apply. Our Privacy Policy explains how we handle personal information.
Please read Section 15. It requires most disputes to be resolved through individual arbitration and waives class actions, unless you opt out.
1. The Service
The Service lets you preview, redact and upload records of your coding-agent sessions, manage them, and earn a share of revenue when they are licensed to AI developers. It also lets AI developers request and license datasets. We may add, change or remove features at any time.
2. Eligibility and accounts
You must be at least 18 years old to create an account. You must give accurate information and keep your login secure. You are responsible for activity under your account, including commands an agent runs on your behalf with your credentials. Tell us right away at hi@selltraces.ai if you suspect unauthorized access.
3. The CLI
We grant you a personal, non-exclusive, non-transferable, revocable license to install and run the CLI to use the Service. You may not:
- use it to upload data you do not have the right to share;
- remove or bypass its confirmation steps for anyone other than yourself;
- modify it to misreport metadata, inflate trace counts or evade review; or
- resell or redistribute it, except as its license allows.
The CLI may update itself when you run selltraces update.
4. Acceptable use
You will not:
- upload content that is illegal, infringing or that you are not permitted to share;
- upload fabricated, synthetic or duplicated sessions to obtain payouts;
- create more than one contributor account or use another person's identity;
- probe, scan or test the Service's security except as allowed in our security policy;
- interfere with the Service, overload it, or access it by automated means other than the CLI and documented API; or
- use the Service to harm others or break the law.
5. Your content
You keep your rights in content you submit. Licenses for uploaded traces are set out in the Contributor Terms. For other content you send us, such as support messages, you grant us a license to use it to operate and improve the Service.
6. Feedback
If you send us suggestions, including feedback an agent submits for you, we may use them without obligation to you.
7. Fees
Using the CLI and contributing traces is free. Data licenses for AI developers are priced under separate written agreements.
8. Third-party services
The Service relies on third parties, including hosting, storage, authentication and payout providers, and works with coding agents made by others. Their terms govern your use of their products. We are not responsible for them.
9. Our intellectual property
We own the Service, including the CLI, website, brand and documentation, except content that belongs to you or others. These Terms do not give you rights in our trademarks.
10. Suspension and termination
You may stop using the Service at any time. We may suspend or end your access if you breach these Terms, if required by law, or to protect the Service or others. Sections 5, 6, 9 and 11 to 17 survive termination.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT REDACTION WILL REMOVE ALL SENSITIVE INFORMATION, THAT ANY TRACE WILL SELL, OR THAT ANY ESTIMATE IS ACCURATE.
12. Limitation of liability
TO THE FULLEST EXTENT ALLOWED BY LAW, SELL TRACES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA OR GOODWILL. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS WE PAID OR OWE YOU UNDER THE CONTRIBUTOR TERMS IN THE 12 MONTHS BEFORE THE CLAIM, AND (B) US $100.
Some states do not allow these limits, so they may not apply to you in full.
13. Indemnity
You will defend and indemnify Sell Traces against third-party claims arising from your breach of these Terms or your misuse of the Service.
14. Governing law
These Terms are governed by the laws of the State of {{GOVERNING_STATE}} and applicable US federal law, without regard to conflict of law rules.
15. Dispute resolution
- Talk to us first. Before filing a claim, email hi@selltraces.ai with a description of the dispute. We will try to resolve it within 60 days.
- Individual arbitration. If we cannot, either of us may start binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The Federal Arbitration Act governs this section.
- Exceptions. Either of us may bring an individual claim in small claims court, or seek an injunction in court to protect intellectual property.
- No class actions. Claims may be brought only individually, not as a plaintiff or class member in any class or representative proceeding.
- Opt out. You can opt out of this Section 15 within 30 days of first accepting these Terms by emailing hi@selltraces.ai with your name and the subject line "Arbitration opt-out".
- Courts. Any claim not subject to arbitration will be brought in the state or federal courts located in {{GOVERNING_STATE}}.
16. Changes
We may update these Terms. If a change is material, we will notify you by email or in the Service before it takes effect. Continued use after the effective date means you accept the change.
17. General
These Terms, with the Contributor Terms and Privacy Policy, are the entire agreement between us about the Service. If a provision is unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition or sale of assets.
